Terms of Service

By creating a Fishtank account or using the service, you agree to these terms. If you do not agree, do not use Fishtank.

1. What Fishtank is

Fishtank is a thin client that uploads your files into your own Google Photos account using the Google Photos API. Fishtank does not own, host, or control the underlying storage. Your files live in your Google account and are subject to Google's terms.

2. Eligibility

You must be at least 13 years old (or the minimum digital-consent age in your jurisdiction) to use Fishtank, and you must have authority to grant access to the Google account you connect.

3. Your responsibilities

  • You are solely responsible for the content you upload, share, or generate links for. This includes responsibility under copyright law, privacy law, and any other law that applies to your content.
  • You will not use Fishtank to upload, store, share, or distribute content that is illegal where you live or where Fishtank is operated, including but not limited to: child sexual abuse material; content that infringes a third party's intellectual property; malware; content that violates export-control or sanctions law; content that harasses, threatens, or defames a person.
  • You will not abuse the service: no attacks against the infrastructure, no automated scraping at a scale that disrupts other users, no attempt to bypass rate limits, quotas, or share-link expiry.
  • You will keep your password and your Google auth blob confidential, and you will revoke them promptly if compromised.

4. Termination

We can suspend or delete your Fishtank account at any time, with or without notice, if we believe you have violated these terms or if continuing to provide you the service would expose us to legal risk. Files already in your Google Photos account remain yours; only the Fishtank-side metadata is removed.

5. No warranty ("AS IS")

Fishtank is provided "as is" and "as available," without any warranty of any kind, express or implied, including (without limitation) any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. You use Fishtank at your own risk. We do not warrant that the service will be available, that data will not be lost, that share links will continue to work, that Google's API will continue to cooperate, or that the underlying steganography technique will not be detected or blocked by Google.

6. Limitation of liability

To the maximum extent permitted by law, the operator of Fishtank is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or in connection with your use of (or inability to use) Fishtank. This applies regardless of the legal theory and even if we have been advised of the possibility of such damages. Where liability cannot be excluded entirely under applicable law, the operator's total aggregate liability to you is limited to USD 50.

7. Indemnification

You agree to defend, indemnify, and hold the Fishtank operator harmless from any claim, demand, loss, damage, cost, or expense (including reasonable legal fees) arising out of: (a) the content you upload, store, or share through Fishtank; (b) your violation of these terms; (c) your violation of any law or third-party right; (d) your misuse of the service.

8. DMCA / takedowns

If a rights-holder reports infringing content, we may remove the affected Fishtank metadata and notify the user. Because the underlying file lives in your Google Photos account, complete removal also requires action via Google.

9. Changes

We may update these terms. Material changes will be reflected by updating the "Last updated" date. Continued use after changes means you accept the new terms.

10. Governing law

These terms are governed by the laws of the operator's jurisdiction. Any dispute will be resolved in the courts of that jurisdiction unless local consumer-protection law requires otherwise.

11. Severability

If any provision of these terms is held unenforceable, the remaining provisions stay in effect.

These terms are intentionally plain-language and may not cover every scenario that applies to your jurisdiction. They do not, and cannot, override mandatory consumer-protection law, criminal liability, or rights you have under applicable law.
